In a seller financed real estate sale, should the seller not release?
Assuming that the seller refused to record a release of the conditional sales contract (or mortgage, if they actually wanted a mortgage instead), a buyers remedy would include filing for a declaratory judgment, adjudging that the lien was satisfied and that the buyer was the lawful owner. If the seller refused to release its claims upon receipt of payment in full, and as a result the buyers title was clouded and the buyer suffered damages, a suit for damages would also be appropriate.
